Use of the Platform is permitted only to:

• Individuals who are at least 18 years old
• Licensed healthcare professionals or authorized representatives
• Corporate entities acting through authorized personnel

By using the Services, you confirm that you meet these eligibility requirements.

PhysioScan provides:

• Real-time posture analysis using image capture technology
• AI-generated posture reports
• Measurement-based exercise recommendations
• Analytical tools to support treatment planning

The Platform is designed as a professional support tool and does not replace independent medical judgment or clinical expertise.

Users agree to:

• Provide accurate and complete information
• Use the Platform only for lawful and professional purposes
• Maintain confidentiality of login credentials
• Obtain all necessary patient consents before uploading data
• Comply with applicable healthcare, privacy, and data protection regulations

Users must not:

• Reverse engineer, decompile, or modify the software
• Attempt unauthorized access to systems or data
• Use the Platform for unlawful, fraudulent, or misleading purposes
• Upload malicious software or harmful code

PhysioScan is a technological support tool.

• The Platform does not provide independent medical diagnosis.
• AI-generated reports are analytical outputs based on image data.
• Clinical decisions remain solely the responsibility of the practitioner.
• The Company is not liable for treatment outcomes based on practitioner decisions.

All intellectual property rights related to the Platform, including:

• Software code
• Algorithms
• AI models
• Reports
• Design elements
• Trademarks and branding

are owned by PhysioScan GmbH or its licensors.

Users are granted a limited, non-exclusive, non-transferable license to use the Platform during the active subscription or agreement period.

Access to certain services may require payment.

• Pricing is defined in separate agreements or subscription plans.
• Payments must be made in accordance with invoicing terms.
• Failure to pay may result in suspension or termination of access.
• All fees are exclusive of applicable taxes unless otherwise stated.

To the maximum extent permitted by law:

• PhysioScan GmbH shall not be liable for indirect, incidental, or consequential damages.
• The Company does not guarantee uninterrupted or error-free operation.
• Liability for simple negligence is limited to foreseeable damages typical for this type of agreement.

Nothing in these Terms excludes liability for:

• Intentional misconduct
• Gross negligence
• Injury to life, body, or health
• Mandatory statutory liability

The Company may suspend or terminate access to the Platform if:

• These Terms are violated
• Payment obligations are not fulfilled
• Use of the Platform poses security risks
• Required by law

Users may terminate their use at any time in accordance with contractual notice periods.

Upon termination:

• Access credentials will be deactivated
• Data handling will follow the Privacy Policy and applicable legal requirements

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions.

If the User is a merchant or legal entity under public law, the exclusive place of jurisdiction shall be Berlin, Germany.

Mandatory consumer protection regulations remain unaffected where applicable.
